PinScout Terms of Use

These Terms of Use govern your use of the PinScout mobile application and related services, provided by Sleepycat Software LLC("Sleepycat Software," "we," "us," or "our").

By creating an account or using PinScout, you agree to these Terms. If you do not agree, do not use PinScout.

1. Eligibility and accounts

PinScout accounts are for individuals. You must be at least 13 years old, and old enough to form a binding contract where you live, to create an account.

You agree to provide accurate account information, keep your sign-in credentials secure, and accept responsibility for activity that occurs through your account. Tell us promptly if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms.

2. Using PinScout

PinScout gives you a limited, personal, non-exclusive, non-transferable license to use the application and service on devices you own or control, subject to these Terms and the rules of the app store through which you obtained the app.

You may not copy, resell, redistribute, reverse engineer, interfere with, or misuse PinScout or its services, including by scraping or automating access, except where applicable law expressly permits it.

3. Alerts, feeds, and third-party shops

PinScout monitors publicly available shop pages and sends alerts when matching products appear. PinScout does not sell products, is not affiliated with or endorsed by the shops it covers, and does not control what those shops list, stock, price, or ship.

Alerts and feeds are informational and may be delayed, incomplete, or inaccurate. Do not rely on PinScout as your only way to catch a drop; you are responsible for verifying price and availability on the shop's own site before purchasing.

Orders, payments, shipping, returns, and refunds are between you and the shop. Shop coverage may change, and individual shops may be paused or removed at any time.

4. Free access and subscriptions

PinScout can be used without a subscription for read-only feed browsing. A subscription unlocks alerts and personalized features. The current price, billing period, and renewal terms are shown in the app before you purchase.

Subscriptions are billed by Apple App Store or Google Play, not by Sleepycat Software, and renew automatically until canceled. You can manage or cancel a subscription through your store account; cancellation takes effect at the end of the current billing period. Deleting the app does not cancel a subscription.

Refund requests and billing disputes are handled according to the policies of the store that processed the purchase. You can restore purchases from the app.

We may change subscription features or pricing with notice as required by the applicable store and law.

5. Your content and conduct

You keep ownership of the filters, requests, and other content you create in PinScout. You grant Sleepycat Software a limited license to host, process, and use that content as needed to operate the service.

You may not use PinScout to break the law, harass others, submit misleading shop requests, attempt to access another person's account, or interfere with the service or its providers.

6. Privacy

Our handling of information is described in the PinScout Privacy Policy.

7. Ownership

PinScout, including its software, design, branding, and other materials, is owned by Sleepycat Software or its licensors. These Terms do not transfer ownership of PinScout or grant rights beyond the limited right to use it. Shop names are displayed only to identify where products are sold.

8. Availability and changes

We may update, modify, pause, or discontinue parts of PinScout, and shop coverage may change. We do not guarantee that every feature or shop will always be available.

We may also update these Terms. The effective date above will be revised when updated Terms are published.

9. Termination

You may stop using PinScout and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if it is needed to protect the service or other users. Provisions that by their nature should survive termination will continue to apply.

10. Disclaimer

PinScout is provided "as is" and "as available." To the maximum extent permitted by law, Sleepycat Software disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

PinScout is an alert and discovery tool. You remain responsible for your purchases and for the decisions you make based on alerts and feed information.

11. Limitation of liability

To the maximum extent permitted by law, Sleepycat Software will not be liable for indirect, incidental, special, consequential, or punitive damages, including missed drops, lost purchases, or lost profits arising from your use of PinScout.

Our total liability relating to PinScout will not exceed the greater of the amount you paid for PinScout in the twelve months before the claim or ten U.S. dollars.

Some jurisdictions do not allow certain warranty exclusions or liability limitations, so portions of these sections may not apply to you.

12. App Store Terms

Your use of PinScout is also subject to the applicable terms of Apple App Store or Google Play. If these Terms conflict with mandatory app-store terms, the applicable app-store terms control.

For applications obtained through Apple App Store, Apple is not responsible for providing maintenance or support for PinScout, and Apple is a third-party beneficiary of the applicable license terms.

13. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules, except where the laws of your jurisdiction require otherwise.
